These Website Terms and Conditions (“Termsâ€) govern your access to and use of the Stratova Marketing website, including information about IntraSit Advertising and any website inquiry, campaign or QR redirect functionality we provide.
In these Terms, “Stratovaâ€, “weâ€, “us†and “our†mean Stratova Marketing, a business operating in Trinidad and Tobago. “IntraSit†means IntraSit Advertising, a service of Stratova Marketing.
By using this website, you agree to these Terms. If you do not agree, please stop using the website.
1. Website purpose
The website provides general information about Stratova Marketing, IntraSit Advertising and related services. It also allows visitors to submit business inquiries and may redirect users who scan an IntraSit QR code to a campaign destination.
Website content is provided for general informational and promotional purposes. It is not legal, financial, technical or other professional advice.
2. No automatic offer or contract
Descriptions of services, fleet availability, campaign possibilities, estimated reach, examples, timelines and other website content do not constitute a binding offer, guarantee or reservation.
Submitting an inquiry does not create a client relationship, reserve a maxi taxi, guarantee campaign availability or require either party to proceed. A service engagement becomes binding only when the parties complete the applicable acceptance process described in a written quotation, proposal, agreement or contract.
If these Terms conflict with an accepted quotation, signed agreement or other written service contract, that service document controls for the subject matter it covers.
3. Quotations, campaigns and payments
Prices, campaign periods, fleet allocations, advertising placements, printing and installation terms, creative changes, payment milestones, cancellation rights and other commercial terms will be stated in the relevant quotation or agreement.
Unless a written quotation or agreement states otherwise:
- all monetary amounts are quoted in Trinidad and Tobago dollars (TTD);
- tax treatment will be stated in the applicable commercial document;
- campaign inventory remains subject to availability until formally confirmed; and
- estimated reach and engagement figures are planning or reporting estimates, not guarantees of individual exposure, scans, sales or other results.
Refunds, cancellations, postponements and creative or production changes are governed by the accepted quotation or agreement and any rights that cannot lawfully be excluded.
4. Acceptable use
You must not:
- use the website for an unlawful, fraudulent, abusive or misleading purpose;
- submit false contact information, impersonate another person or misrepresent your authority to act for a company;
- upload or transmit malware, harmful code or content that infringes another person’s rights;
- attempt to gain unauthorised access to the website, WordPress administration, TransitTrack, Business Manager, the mobile API or related systems;
- interfere with security, availability, analytics or QR redirection;
- generate automated or artificial QR scans or manipulate campaign reporting;
- scrape, harvest or systematically extract website or campaign data without written permission; or
- copy, modify or commercially exploit website content except as permitted by law or with our written permission.
5. Information and materials you submit
You are responsible for ensuring that information and materials you submit are accurate, lawful and supplied with the necessary authority and permissions.
You retain ownership of materials you provide. You grant Stratova a limited, non-exclusive permission to use, reproduce and adapt those materials only as reasonably necessary to evaluate the inquiry, prepare requested documents, provide agreed services, produce campaign creative and maintain relevant business records.
Confidentiality obligations stated in a separate written agreement remain unaffected.
6. Intellectual property
The website design, written content, graphics, logos, service names, software presentation and other materials owned by Stratova are protected by applicable intellectual-property laws. “Stratova Marketingâ€, “IntraSit Advertisingâ€, associated logos and campaign systems may not be used in a way that suggests endorsement, partnership or ownership without prior written permission.
Client trade marks, campaign artwork and third-party materials remain the property of their respective owners.
7. QR codes and third-party destinations
IntraSit QR codes may redirect to a website, survey, offer, coupon, registration page, advisory or other destination selected for a campaign. A destination may be operated by the campaign client or another third party.
Unless Stratova operates the destination, we do not control its content, availability, products, privacy practices or security. A redirect does not by itself constitute an endorsement. Use of a third-party destination is subject to that provider’s terms and privacy practices.
8. Website availability and accuracy
We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access. We may correct, update, suspend or remove website content or functionality at any time.
Campaign availability, route participation, fleet allocations, prices and other operational details may change. Confirm material information in the applicable quotation or agreement before relying on it.
9. Disclaimers
To the fullest extent permitted by law, the website is provided on an “as available†basis without warranties that are not expressly stated in a binding written agreement.
Stratova does not guarantee particular levels of passenger attention, QR scans, estimated unique scans, website visits, leads, sales, revenue or other campaign outcomes. Reach, engagement and uniqueness figures are estimates based on available operational and technical data.
Nothing in these Terms excludes or limits a warranty, remedy, right or liability that cannot lawfully be excluded or limited.
10. Limitation of liability
To the fullest extent permitted by law, Stratova will not be liable for indirect, incidental, special or consequential loss arising solely from use of, inability to use, or reliance on the public website or a third-party destination.
This website limitation does not replace any liability provision in an accepted quotation or agreement and does not apply where liability cannot lawfully be excluded or limited.
11. Privacy
Our Privacy Policy explains how we handle personal information collected through the website, business communications and IntraSit QR analytics.
12. Changes to these Terms
We may revise these Terms to reflect changes to the website, services or law. The revised Terms take effect when posted with an updated date. Changes do not retroactively alter an accepted quotation or signed agreement unless the parties agree in writing.
13. Governing law
These Terms are governed by the laws of the Republic of Trinidad and Tobago. The courts of Trinidad and Tobago have jurisdiction over disputes concerning the public website, subject to any valid dispute-resolution provision in a separate agreement and any mandatory rights under applicable law.
14. Severability and waiver
If a provision of these Terms is held unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A delay in enforcing a provision is not a waiver of that provision.
